1 Promotion
1.1 These terms and conditions apply to the Malvern Community Voting Intentions Survey Prize Draw.
1.2 The promotion is conducted as a free-entry trade promotion lottery in Victoria under the Gambling Regulation Act 2003 (Vic) and the Gambling Regulations 2026 (Vic).
1.3 The promotion is designed to encourage eligible people to complete a community survey about voting intentions and community opinions in relation to the 2026 Victorian state election.
1.4 The promotion is not sponsored, endorsed, administered by, or associated with Meta, Facebook, Instagram, the Victorian Electoral Commission, any political party, candidate, elected representative, government body, or gift-card issuer, unless expressly stated by the Promoter.
2 Promoter
2.1 The promoter is Voices of Malvern, an association, of 1 Hughes St, Malvern East VIC 3145.

2.3 The promotion primarily benefits the Promoter by assisting it to conduct community research and understand voting intentions and opinions within the electorate of Malvern.
2.4 If the promotion is conducted to promote the trade, business, activities, or interests of any person other than the Promoter, the Promoter must obtain that person’s prior written consent and written agreement that entrant information will only be used for the purposes stated in these terms.
3 Promotion period
3.1 The promotion opens on 5 July 2026.
3.2 The promotion closes at 4 August 2026 or earlier if decided by the Promoter.
3.3 Entries received after the closing time will not be eligible for the prize draw.
4 Eligibility
4.1 Entry is open only to individuals who, at the time of entry:
(a) are aged 18 years or over;
(b) are Australian citizens;
(c) are enrolled, or eligible to be enrolled, to vote in the 2026 Victorian state election;
(d) ordinarily reside at an address within the Victorian state electoral district of Malvern;
(e) complete all survey questions marked as required;
(f) provide any required consents and acknowledgements in the survey entry form; and
(g) provide accurate contact details for the purpose of prize-draw administration.
4.2 “Prefer not to say”, “Undecided”, “None of the above”, or similar response options will count as valid answers where those options are provided in the survey.
4.3 The following people are not eligible to enter the prize draw:
(a) committee members, officers, employees, contractors, and volunteers of the Promoter who are directly involved in designing, administering, drawing, or auditing the promotion;
(b) immediate family members of the people listed in clause 4.3(a); and
(c) any person who does not satisfy the eligibility requirements in clause 4.1.
4.4 The Promoter may require a selected winner to provide reasonable evidence of eligibility, including evidence of age, identity, Victorian residence, and residence within the electoral district of Malvern. The Promoter will only request information reasonably necessary to verify eligibility.
5 How to enter
5.1 To enter, an eligible entrant must, during the promotion period:
(a) access the survey via a link provided by the Promoter;
(b) complete all questions marked as required;
(c) confirm that they meet the eligibility requirements;
(d) provide their name, email address, and telephone number for prize-draw administration; and
(e) submit the completed survey entry form.
5.2 Entry is free. The Promoter will not charge an entry fee. Entrants are responsible for any ordinary internet access or mobile data costs charged by their own service provider.
5.3 No purchase, donation, membership, payment, political support, political opinion, or vote choice is required to enter.
5.4 An entrant’s chance of winning is not affected by their survey answers, voting intention, political opinion, membership status, donation history, or support for any candidate, party, elected representative, or political issue.
5.5 Maximum one entry per person. If multiple entries are submitted by the same person, only the first valid complete entry received will be included in the draw.
5.6 Automated, bulk, incomplete, false, misleading, fraudulent, offensive, or unlawful entries may be deemed invalid.
6 Prize
6.1 There is one prize: one $250 gift card.
6.2 The total prize pool is $250.
6.3 The prize is not transferable, exchangeable, or redeemable for cash, except where required by law.
6.4 The gift card is subject to the issuer’s terms and conditions, including any expiry date, activation requirements, lost-card terms, or restrictions on use.
6.5 The Promoter is not responsible for any tax consequences arising from acceptance or use of the prize. Entrants should obtain their own advice if needed.
7 Draw
7.1 The draw will take place at the first Voices of Malvern committee meeting after entries closed. This will be no later than 9.00 pm Melbourne time on 10 August 2026 via a virtual committee meeting.
7.2 The draw will be conducted by random selection from all valid eligible entries.
7.3 The draw method will give each valid eligible entry a random and equal chance of being drawn.
7.4 Entrants do not need to be present at the draw to be eligible to win.
7.5 The Promoter’s decision is final, subject to any rights an entrant may have under applicable law.
8 Winner notification and publication
8.1 The selected winner will be notified in writing by email and/or SMS within 7 days following the draw.
8.2 The prize will be transferred to the winner within 28 days after the draw, provided the winner is readily identifiable and has satisfied any reasonable eligibility verification requirements.
8.3 The winner’s first name, last initial and suburb may be published on the Voices of Malvern website if required by law.
8.4 By entering the prize draw, entrants consent to the publication described in clause 8.3.
8.5 Entrants who do not consent to this potential publication should not enter the prize draw, but may still complete the survey if the Promoter allows non-prize survey participation.
9 Unclaimed prize and redraw
9.1 The Promoter will make reasonable efforts to identify and contact the selected winner.
9.2 If the selected winner:
(a) cannot be readily identified;
(b) cannot be contacted after reasonable efforts;
(c) does not respond within 2 days after the Promoter’s first written notification;
(d) is found to be ineligible;
(e) has submitted an invalid entry; or
(f) declines the prize,
the Promoter may select a substitute winner by an additional random draw.
9.3 The same random and equal chance method described in clause 7 will be used for redraw. This may be conducted in the one meeting to have a list of backup winners available.
9.4 Any substitute winner will be notified in writing and will be subject to these terms.
10 Prize substitution
10.1 The Promoter may substitute the prize only where permitted by law.
10.2 If the prize becomes unavailable for reasons beyond the Promoter’s reasonable control, the Promoter may substitute a prize of the same or greater value if:
(a) the winner agrees in writing; or
(b) the Promoter has made reasonable attempts to reach agreement with the winner and those attempts are unsuccessful.
11 Use of survey responses and entrant information
11.1 The survey asks questions about voting intentions and opinions. Some survey answers may reveal political opinions or other sensitive information.
11.2 By completing the survey and entering the prize draw, entrants consent to the Promoter collecting and using their survey responses for the following purposes:
(a) understanding voting intentions and community opinions in the electoral district of Malvern;
(b) analysing, summarising, and reporting survey results;
(c) preparing internal research reports for the Promoter;
(d) publishing aggregated or de-identified survey findings; and
(e) keeping records needed to administer and verify the promotion.
11.3 The Promoter will use entrants’ personally identifying details, such as name, email address, telephone number, and any eligibility-verification information, only for:
(a) administering the prize draw;
(b) verifying eligibility;
(c) contacting the winner;
(d) transferring the prize;
(e) handling enquiries, complaints, and disputes; and
(f) meeting legal, regulatory, audit, and record-keeping obligations.
11.4 The Promoter will not use personally identifying details to analyse or publish voting intentions.
11.5 Where practicable, the Promoter will separate prize-draw contact details from survey responses after the close of the promotion.
11.6 The Promoter may use survey responses without personally identifying details to understand voting intentions and opinions. However, the Promoter will take reasonable steps not to publish individual-level responses in a way that is likely to identify an entrant.
11.7 The Promoter will not sell entrant information.
11.8 The Promoter will not use entrant contact details for direct marketing, political campaigning, voter targeting, fundraising, membership solicitation, or future advertising unless the entrant has separately and expressly consented to that use.
11.9 The Promoter will not provide identifiable survey responses to any political party, candidate, elected representative, campaign organisation, advertiser, data broker, or social media platform unless required by law or expressly consented to by the entrant.
11.10 The Promoter may disclose information to service providers who help administer the survey, draw, data storage, analysis, communications, or prize fulfilment, but only for the purposes stated in these terms and on terms requiring appropriate confidentiality and information security.
12 Records
12.1 The Promoter will keep accurate records for at least 3 years after the promotion is finalised, including:
(a) financial accounting for the promotion;
(b) accounting for all entries;
(c) the draw method and draw result;
(d) winner notification records; and
(e) prize distribution records.
12.2 Records will be kept securely and accessed only by people who reasonably need access for promotion administration, compliance, or dispute handling.
13 Fair conduct
13.1 The Promoter will conduct the promotion in a manner that is not offensive and not contrary to the public interest.
13.2 The Promoter may disqualify an entrant who tampers with the entry process, submits false information, uses automated entry methods, breaches these terms, acts unlawfully, or engages in conduct that is offensive, abusive, misleading, or contrary to the fair administration of the promotion.
13.3 The Promoter may suspend, cancel, postpone, or modify the promotion if it cannot be conducted as planned due to circumstances beyond the Promoter’s reasonable control, including fraud, technical failure, platform outage, unauthorised intervention, legal restriction, or other causes affecting the integrity or proper conduct of the promotion. The Promoter will do so only to the extent permitted by law.
14 Facebook and online advertising
14.1 The promotion may be advertised on Facebook, Instagram, or other online platforms.
14.2 Entrants acknowledge that Meta and its related entities are not responsible for the promotion.
14.3 Any questions, comments, or complaints about the promotion should be directed to the Promoter.
15 Liability
15.1 Nothing in these terms limits, excludes, or modifies any rights or remedies that cannot be excluded under Australian law.
15.2 To the extent permitted by law, the Promoter is not liable for:
(a) late, lost, misdirected, incomplete, corrupted, or invalid entries;
(b) technical, network, platform, software, or communications failures;
(c) unauthorised access to or interference with entries;
(d) loss or damage arising from use of the prize; or
(e) any failure by a gift-card issuer or third-party service provider.
16 Complaints and enquiries
16.1 Promotion enquiries or complaints may be sent to [email protected].
16.2 The Promoter will review complaints in good faith and may request further information reasonably needed to assess the complaint.
17 Governing law
17.1 These terms are governed by the laws of Victoria, Australia.
17.2 Entrants submit to the non-exclusive jurisdiction of the courts and tribunals of Victoria.
